<p><b>Can I sell my FSBO house, when 1st buyer terminated contract and earnest money is still disputed?</b>
<p>The 1st buyer was during a listing time, which is outdated and the buyers backed out 4 days before closing.  The new buyers (FSBO) have earnest money<span id="more-96"></span> at a different title company.  The 1st buyers have terminated contract, but we cannot agree on earnest money dispersement.</p>

<p>One of the most transparent benefits of an FSBO home sale to many home owners is that sticking that &#8216;For Sale By Owner&#8217; sign in their front yard says that they might have some control over the selling of their home. However, what are the benefits<span id="more-95"></span> of an FSBO home sale, and how do you go about doing it.</p>
<p>While not a &#8216;benefit&#8217;, one of the first things to remember when thinking about an FSBO home sale is that no matter where you are, the entire task can seem somewhat daunting and complicated. Adding to the complications is the fact that not only are there all kinds of legal forms required (if you have ever bought a home you know what I mean), but that requirements may vary from state to state. A California &#8216;for sale by owner&#8217; home sale is probalby going to be different from a Texas FSBO transaction.</p>
<p>You might wonder that; if going the &#8216;for sale by owner&#8217; route is so complicated and messy, why am I including this comment in an article for someone who is contemplating putting up their home in a &#8216;for sale by owner&#8217; offering?</p>
<p>Well, let&#8217;s talk about those benefits.</p>
<p>1. The FSBO Kit &#8211; Despite the potential complexities, there are many companies which offer what could be called an FSBO kit. Depending upon the company, this kit will provide the homeowner with the FSBO legal forms, and hopefully some guidance on preparation and filing of the &#8216;for sale by owner&#8217; documents.</p>
<p>However, be advised that an FSBO kit may range from simply the basic or most common forms needed with some instructions on how to fill them out and where to file them, to very complete FSBO kits which include ALL the legal forms needed, instructions on how to fill them out, where to file them, instructions on how to prepare your home for sale, how to advertise your home for sale effectively, and, in some cases, contact with a listing service which will help put the home out in front of prospective buyers.</p>
<p>2. Growing Public Acceptance of the FSBO Process &#8211; A few years ago, most buyers would have been wary of a home with an FSBO sign in the front yard. However, since more and more home owners have opted in for this type of home sale, not only are many more people actually looking for those signs, but an entire support industry seems to have sprung up to assist the homeowner who has decided to try the &#8216;for sale by owner&#8217; route. Newspapers offer advertising packages and guidance, for example, and even some realtors have jumped on the bandwagon by offering assistance and guidance to the homeowner &#8211; for a fee, of course.</p>
<p>3. A Desire for Control of the Home Sale Process &#8211; I alluded to this above in the opening paragraph. Many people just want to have some control over the process and not feel that they are a pawn in the hands of the real estate agent.</p>
<p>Additionally, some people want to be involved in showing the house, explaining its values and even such simple things as &#8216;how nice the next door neighbor is&#8217; to prospective buyers. Some people feel that this more personal approach may do more to sell the house than a realtor&#8217;s remark about how the owner mentioned that it was a nice neighborhood to live in.</p>
<p>4. Saving Real Estate Commissions and Fees &#8211; I saved this for last, just because I knew you wanted to see it first! Actually, I do not necessarily consider savings to be the main reason that ALL people choose to go with an FSBO home sale, but it is certainly a primary factor for a large percentage of home sellers. On the other hand, many of us simply believe that we don&#8217;t mind paying if we know what we are paying for. When that realtor walks off with a large commission, we often wonder what he or she did to earn it.</p>
<p>While &#8216;for sale by owner&#8217; will certainly very often offer savings, ranging from small to large amounts, many of us are just happy to know where our money is going. While there is almost no concrete way to measure how much money is actually saved in an FSBO home sale, there will almost always be some savings, if the process is done correctly and efficiently.</p>
<p>For most, the FSBO home sale will be a rewarding experience if done properly. If you are not an experienced home seller, probably the best way to be successful is to do your homework and get your hands on the best FSBO kit you can find.</p>

<p>When you decide to sell your home without a real estate agent, you enter the world of the FSBO sellers. As with any new experience, you need to understand some of the basic language.<br /><span id="more-94"></span></p>
<p>FSBO Jargon &#8211; The Language of the FSBO Seller</p>
<p>Selling your home on your own makes a lot of sense from a financial perspective. Even though the real estate market has cooled off considerably, home prices are still pumped up compared to historical references. At 6 percent, the commission of a real estate agent can add up to a lot of money. On a $500,000 home, we are talking about a whopping $30,000, which can really eat into the equity you have built up over the years. </p>
<p>If you make the decision to go FSBO, you need to understand a few things. You are essentially taking the oars of the boat and doing all the rowing yourself. This means you need to understand both the concepts involved and the language used during the real estate process. Here are some tips.</p>
<p>FSBO &#8211; This term is short for &#8220;For Sale By Owner&#8221;. It is important to understand that it is used as a noun in the real estate industry. Simply put, you are a FSBO. Agents helping buyers will refer to you and your property by this term. Selling agents will also contact you frequently to try to convert you from a FSBO to a listing client, to wit, they want you to hire them. </p>
<p>FFMLS &#8211; This term refers to Flat Fee Multiple Listing Service. Many people that consider selling their home with an agent worry that they will not be able to list their property in the multiple listing service for the area. In the past, the &#8220;MLS&#8221; was a list controlled solely by agents and realtors. These days, there are ways to access it without using a real estate agent. You can pay a Flat Fee for your listing, thus the name. </p>
<p>CMA &#8211; This term refers to a Comparable Market Analysis. It is essentially a breakdown of homes in your neighborhood. Information includes things such as the listing prices of homes, valuations and so on. As a FSBO seller, you can obtain a CMA by just contacting a real estate agent. They use these reports as lead generators and give them out for free. Tell them you are a FSBO and they will still give you one. The eternal hope of the agent, of course, is that you will fail as a FSBO and hire them.<br />

<p>Obviously, there are many terms that arise in the real estate world. Most apply whether or not you are using an agent to promote your property. The above represent a couple you need to know as a FSBO.</p>

<p><b>Is there a book or reference out there on guerilla marketing FSBO rental property real estate for dummies?</b>
<p>I don&#039;t know the name of the book off hand but it shouldn&#039;t be too hard to find on the book store shelf&#039;s.  The particular<span id="more-93"></span> author advocates auctioning off your property within 5 days in a &#8220;round robin&#8221; style auction.  Basically, you begin by inserting a classified ad on a Sunday  indicating the Property will be sold to the highest bidder by the following Sunday say at 10 pm; then you hold an open house that Friday, Saturday and Sunday.  Bids are accepted at any point during the open house.  Come Sunday evening, you begin notifying the low bidders of the highest bid received then you offer them the opportunity to raise their bids or concede.  That goes on until there are no more bids.</p>
<p>I don&#039;t know of anyone who has tried it but I seen the author featured on several news programs and the book is a best seller.   I don&#039;t think that you can get any more guerrilla than that!</p>
<p>Hope that helps a little!  Where is the property located?  I might be interested.  I buy and sell real estate myself.  Simple classified ads have always worked for me.  I have also had success on www.virtualfsbo.com as well.  It is free to use!</p>

<p>While FSBO (For Sale By Owner) sales do occur, four out of five homeowners still use a real estate agent. Why? Because selling your home on your own is hard work, and even more importantly, statistics prove that real estate agents get homes<span id="more-92"></span> sold faster and for more money than FSBOs.</p>
<p>If you&#8217;re not sure what you should do, here are a few things to think about:</p>
<p>FSBO Sometimes, for sale by owner purchases are a good deal for the homeowner. That doesn&#8217;t mean you should just jump in, however. FSBO might be a good thing for you if:</p>
<ol>
<li>It&#8217;s a seller&#8217;s market</li>
<li>You don&#8217;t care how long it takes</li>
<li>You are unwilling to pay the typical real estate agent commission</li>
<li>You have a good attorney who can keep you protected for the legal aspects</li>
<li>You have the time to learn how to do it, answer the phone and provide open houses</li>
<li>You&#8217;re comfortable negotiating</li>
<li>You&#8217;re confident you can price your home correctly</li>
</ol>
<p>Real Estate Agent Although you will have to pay your agent a commission, there are some definite benefits to hiring one:</p>
<ol>
<li>A good agent can help you price your home correctly.</li>
<li>They have an abundance of resources to help find buyers, get the best price and get your home sold.</li>
<li>They make sure the potential buyer can actually afford it.</li>
<li>They&#8217;re good at negotiating and aren&#8217;t emotionally invested in the sale.</li>
<li>If for no other reason, they&#8217;re interested in getting the highest price possible because of their commission.</li>
<li>They put in several hours a day, that you may not have available, to get your home sold.</li>
<li>They have advertising resources, such as real estate magazines, that you may not be able to touch (or afford).</li>
</ol>

<p>When I see one of these<span id="more-90"></span> red and white plastic signs or the signs that some FSBO listing services provide flapping around on their flimsy wire frame (you know which ones I mean), it screams to me that:</p>
<p>
<ul>
<li>The sellers don&#8217;t know what they are doing.</li>
<li>The sellers don&#8217;t really care if they sell the house or not.</li>
<li>The sellers aren&#8217;t taking the sale of their house seriously.</li>

<p>Negotiation is where many FSBO home sellers really have problems. The wrong attitude or a slip of the tongue could cost you thousands. Here are a few pointers to keep you on<span id="more-88"></span> the right path:
<p>1. Show interest in selling the house. In an effort to project a sense of strength many people either take an aggressive &#8220;take it or leave it&#8221; attitude, or they appear to be overly relaxed, almost disinterested. It is better to have an open mind, stay calm, be helpful. </p>
<p>Carefully investigate and analyze the facts. Make an intelligent response to the buyer. Being helpful makes it easier for the buyer to relax and be more willing to see your point of view. </p>
<p>2. Listen carefully to what the buyer has to say. Try to learn about the buyer&#8217;s needs, wants, desires, fears, frustrations and problems that need solving. This will give you the information you need to work with the buyer and close the deal. </p>
<p>3. Don&#8217;t let your personal feelings get in the way of accepting a good offer. Don&#8217;t get thrown off by the little eccentricities of people. You may not like the buyer, but that doesn&#8217;t matter. A little patience on your part could make you thousands of dollars. After the sale of the house, you never have to see him again. Keep emotions and finances separate. </p>
<p>4. Use time to your advantage. If at all possible, try not to be squeezed for time. Find out if the buyer has to move in by a certain deadline. The closer the deadline, the more they will be willing to pay a little higher for a quick close. </p>
<p>5. Close using the mortgage payments rather than the price of the house. You would be surprised how little the monthly mortgage payment changes when the asking price changes by several thousand dollars. <p>6. Stack the benefits in your favour. Try to include several factors that can be negotiated instead of just the price. For example, you can include blinds, furniture, tools or other items to enrich your offer. Try to trade-off some of the bonus items instead of reducing the price. </p>
<p>7. Create a win-win situation. If the buyer feels like they are getting the short end of the stick it will be difficult to close the deal. They have to feel like they are winning. Here&#8217;s how Roger Dawson put it in his book, &#8220;The Secrets of Power Negotiating&#8221;: &#8220;When you get the gold out of their teeth, that&#8217;s not negotiating. That&#8217;s stealing. When you get the gold out of their teeth and they thank you for it, that&#8217;s negotiating.&#8221; </p>
<p>If you follow these points you will certainly be on the right path to selling your house for a higher price. However, there are many tactics and strategies you can use or that the buyer will use on you. A little time spent on preparation can literally save you thousands. </p>

<p>dad called and said a friend is interested in our house, but wanted to know when our real estate contract is up because they are interested in going FSBO to save on commission. they stopped by and looked in the windows and they like the house. we told them our contract is up mid-july and that we&#039;d be willing to work with them then, if it hasn&#039;t sold by then. </p>
<p>i am having a dilemma here, as the agent has spent time and $ on advertising and such, so am i a terrible person for considering this? some people say it&#039;s wrong to not sell through the agent now that i&#039;ve signed a contract, period.  others say to break the contract and snatch up these buyers.  i just want to SELL!!  any opinions or advice please?!?!</p>
